Data protection information in the context of video surveillance

In the context of video surveillance at the Fraunhofer Institute for Environmental, Safety and Energy Technology UMSICHT, we, as the data controller, process your personal data. In the following, we will inform you about what data is involved, how it is processed and what rights you are entitled to in this regard.

According to Art. 4 No. 1 of the General Data Protection Regulation (GDPR), personal data is any information relating to an identified or identifiable natural person.

 2. Processing of personal data and purposes of processing

Categories of personal data

The following categories of data are processed as part of video surveillance at Fraunhofer UMSICHT:

  • Image data
  • Transaction data
  • Date and time

Legal basis and processing purposes

Your personal data is processed for the purpose of securing the Fraunhofer UMSICHT building, for the investigation and prevention of criminal offenses, for the preservation of evidence in the event of an incident and for the protection of property and possessions.

The processing is based on our legitimate interest in the protection of property, protection of employees, law enforcement and access control (Art. 6 para. 1 lit. f GDPR).

Duration of storage of personal data

Your personal data will be deleted no later than 14 days after storage. Exceptions to this are only made to preserve evidence in the event of an incident.

3. Disclosure of personal data

We only pass on your personal data if

  • you have given your express consent to this in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR;
  • there is a legal obligation for the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR.

4. Rights of data subjects

As a data subject within the meaning of data protection law, you have the following rights:

  • in accordance with Art. 15 GDPR, to request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;
  • in accordance with Art. 16 GDPR, to immediately request the correction of incorrect or incomplete personal data stored by us;
  • in accordance with Art. 17 GDPR, to demand the deletion of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • in accordance with Art. 18 GDPR, to demand the restriction of the processing of your personal data if the accuracy of the data is disputed by you, the processing is unlawful but you refuse to delete it, we no longer need the data but you need it to assert, exercise or defend legal claims or you have lodged an objection to the processing in accordance with Art. 21 GDPR;
  • to lodge a complaint with a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority at your usual place of residence or workplace or at our registered office.

Information about your right to object in accordance with Art. 21 GDPR

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) of Article 6(1) GDPR (data processing in the public interest) and point (f) of Article 6(1) GDPR (data processing on the basis of a balancing of interests); this also applies to profiling based on this provision under Article 4(4) GDPR.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims.

If you object to the processing of data for the purpose of direct marketing, we will cease processing immediately. In this case, it is not necessary to specify a particular situation. This also applies to profiling insofar as it is associated with such direct advertising.
